Otiket Membership Agreement

1. PARTIES

This Membership Agreement (hereinafter referred to as "Agreement") is made between Otiket Basım Sanayi Ticaret Limited Şirketi, operating at Yakuplu Mah. Beysan San. Sit. Dereboyu Cad. No:15/3 Beylikdüzü / İstanbul (hereinafter referred to as "otiket.com.tr" or "Site"), and a natural or legal person who is a member of the internet site named www.otiket.com.tr and approves this agreement electronically (hereinafter referred to as "Member").

2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is to determine the terms of the Member's benefiting from the printing, labeling, and packaging production services offered on the Otiket internet site, and the rights and obligations of the parties.

3. MEMBERSHIP TERMS AND MEMBER'S OBLIGATIONS

3.1. Declaration of Accurate Information: The Member declares that the personal and corporate (invoice, tax number, address, etc.) information provided during registration on the site is accurate and up-to-date. The Member accepts and undertakes to immediately compensate Otiket for any damages incurred due to the inaccuracy of this information. In the case of corporate memberships, the person carrying out the transaction accepts and declares that they are authorized to represent the corporation. 3.2. Account Security: The Member may not give their created password to other individuals or organizations; the right to use the password belongs exclusively to the Member. All legal and criminal liability arising from the unauthorized use of the account rests with the Member. 3.3. Responsibility for Design and Copyright: The Member declares that they own the usage rights or copyrights for all designs, logos, texts, visuals, and documents uploaded to the site for printing purposes. In the event that the uploaded content infringes the intellectual and industrial property rights (trademark, patent, copyright, etc.) of third parties, all legal and criminal liability shall rest with the Member. Otiket reserves the right to seek recourse from the Member for any material/moral damages incurred due to such infringements. 3.4. Lawful Use: The Member agrees to act in accordance with general morality, public order, and applicable laws of the Republic of Turkey when using the site. The Member cannot create orders with content that constitutes a crime, is threatening, or illegal via the site. 3.5. Prohibition of System Interference: The Member may not use software (bots, viruses, etc.) that disrupts or slows down the operation of the site, or accesses the data of other members without authorization.

4. RIGHTS AND OBLIGATIONS OF OTIKET

4.1. Membership Cancellation: If Otiket determines that the Member has acted contrary to the provisions of this Agreement, it may freeze, cancel, or block the Member's access to the site without prior notice. 4.2. Content and Production Rejection: Otiket reserves the right to refuse to print designs uploaded by the Member for technical (low resolution, etc.) or legal (suspicion of copyright infringement, immorality, etc.) reasons, and to cancel the relevant order. 4.3. Service Changes: Otiket reserves the right to change the product options, materials, production times, and pricing offered on the site at any time, without prior notice. 4.4. Infrastructure and Interruptions: The site may be temporarily out of service due to maintenance, updates, or force majeure events related to the server. Otiket cannot be held responsible for these interruptions.

5. INTELLECTUAL PROPERTY RIGHTS

The general appearance, design, source codes, texts, and all graphic materials of the Otiket internet site are copyrighted by [Full Commercial Name of the Company to be Established]. They may not be copied, reproduced, or used in another project without permission. The rights to the Member's own designs uploaded for an order remain with the Member; Otiket.com uses these designs only for the purpose of fulfilling the order.

6. CONFIDENTIALITY AND PERSONAL DATA

The Member declares that they have read, understood, and accepted the "KVKK Clarification Text" located at the bottom of the site regarding the processing, protection, and transfer of personal and corporate data shared during registration and transactions on the site.

7. TERMINATION OF THE AGREEMENT

This Agreement shall remain in force until the Member cancels their membership or until their membership is canceled by Otiket.

8. RESOLUTION OF DISPUTES

Turkish law shall apply to disputes arising from the implementation and interpretation of this Agreement.

  • If the Member is an individual consumer, the authorized bodies are the Consumer Arbitration Committees and Consumer Courts in the place of residence of the Buyer or Seller.

  • If the Member is a corporate entity (merchant/tradesperson), the Istanbul Courts and Enforcement Offices are authorized.

9. EFFECTIVENESS

By filling out the membership form and clicking the "Become a Member" or "I Accept the Agreement" button, the Member signifies that they have read and accepted all articles contained in this Agreement. The Agreement enters into force immediately upon the Member's electronic approval.
